Claimant worked as a maintenance supervisor for City of Melbourne and sustained foot fracture while climbing stairs at City facility. Claim was denied based on based on Major Contributing Cause, Preexisting Condition, Increased Risk and Arising Out of and In the Course and Scope of Employment defenses. JCC Dietz ruled in favor of our client. Claimant appealed, and the First DCA affirmed the decision based on the recent post-Valcourt line of cases.
